Terms of Service

1. General

1.1 These terms and conditions apply to all sales of goods (Goods) by A. Royale & Co (Aust) Pty Ltd ACN 002 428 382 PO Box 5024, Chullora (Fly First™) to you, the purchaser of the Goods.
1.2 These terms and conditions can only be waived in writing signed by an authorised officer of Fly First™.

2. Orders

2.1 Your order for Goods (Order) must contain your correct name, invoice address, delivery address, telephone number, email address, credit card details and any other details Fly First™ requires to process and deliver your order.
2.2 By placing your Order with Fly First™, you offer to purchase Goods at the price specified in the Order.
2.3 Fly First™ reserves the right to accept or reject any Order within 7 days of receiving the Order.
2.4 You must not order Goods for the purpose of re-selling or re-supplying them to third parties.
2.5 Fly First™ may at any time cancel, vary or suspend all or some of the Orders you have placed without any liability to you:
    (a) if you breach any of these terms and conditions in respect of an Order;
    (b) Fly First™ has insufficient stock to fulfil your Order; or
    (c) Fly First™ does not deliver to your nominated delivery address.
2.6 If Fly First™ rejects an Order or cancels all or any part of an Order, you will be notified by email and Fly First™ will refund any amount you have paid in advance for the Order.

3. Price and Payment

3.1 The price payable for Goods is set out on this website and is in $AUD.
3.2 The price includes the Goods and Services Tax (GST) but not any postage, handling, freight, insurance, customs charges and other charges affecting the cost of the Goods. You will be notified of these additional costs and given a total purchase price before finalising your Order.
3.3 You must pay the full price for the Goods you order at the time you place your Order. Payment must be made using the online ordering facility and via the methods Fly First™ offers on this website. Orders that exceed your credit limit will not be processed.

4. Delivery

4.1 Fly First™ will deliver the Goods ordered to the delivery address provided when you placed your Order.
4.2 Any delivery times notified to you are estimates only and Fly First™ is not liable for late or non-delivery.
4.3 Fly First™ may, at your request, agree to postpone delivery of the Goods to a time more convenient to you provided that you agree to pay Fly First™ an additional amount for such postponement and storage charges.
4.4 Title and the risk of loss or damage to the Goods passes to you upon delivery to the delivery address.

5. Return of Goods

5.1 Fly First™ does not offer refunds for change of mind or incorrect decisions. Subject to this clause, if you are not satisfied with the Goods for any reason, you may return them within 30 days of delivery. This guarantee does not apply to Goods damaged by misuse, abnormal usage, or unauthorised repairs.
5.2 You must inspect the Goods upon delivery and notify Fly First™ of any damage within 48 hours, including photographic evidence.
5.3 Goods must be returned with original packaging, accessories, and a copy of the tax invoice, by registered post to PO Box 5024, Chullora NSW 2190, including your contact details and reason for return.
5.4 Except as required by law or otherwise stated, Fly First™ is not obliged to accept returns or cover return shipping costs. Returns marked “Cash or cheque on delivery” or “More to pay” will not be accepted. If the return is refused, Fly First™ will notify you in writing.
5.5 Refunds will not be issued until the returned Goods are inspected and deemed eligible under this clause.
5.6 These terms do not limit your rights under the Australian Consumer Law.

6. Limitation of Liability

6.1 To the fullest extent permitted by law, all warranties, guarantees or representations not expressly stated in this agreement or provided in writing by Fly First™ are excluded. If Fly First™ is found liable for breach of a guarantee, its liability is limited to:
    (a) replacing the Goods or supplying equivalent Goods;
    (b) repairing the Goods;
    (c) covering the cost of replacement or equivalent Goods; or
    (d) covering the cost of repairs.
6.2 Fly First™ is not liable for any indirect, special, or consequential loss or damage—including lost profit, opportunity, or data—arising from the use or non-supply of Goods.

7. General

7.1 This agreement is governed by the laws of New South Wales. You submit to the non-exclusive jurisdiction of its courts.
7.2 All notices under this agreement must be in writing and sent to the recipient’s nominated address.
7.3 If any clause or part of this agreement is invalid, illegal or unenforceable, that portion will be removed but the remainder will remain in full force.
